Mignon Potenza Real Estate Srls, trading as, Lux Stays Puglia acts as an Agent supplying Accommodation, on behalf of property owners in Italy. Our responsibility to you is to take reasonable care in selecting the accommodation supplied. Your contract will be with the Property Owner. These Booking Conditions will apply to that contract.
Mignon Potenza Real Estate Srls, trading as, Lux Stays Puglia is a sales agent acting on behalf of the accommodation provider. By proceeding with your booking you confirm that you accept our terms and conditions as they set out our respective rights and obligations.
All bookings are subject to these terms and conditions.
When you make a booking as Party Leader, you guarantee that you have the authority to accept and do accept on behalf of your party these terms and conditions. You must be at least 18 years old to make a booking with us. Your contract with Lux Stays Puglia is made with us on the earliest of either: a) The Party Leader tells us that you would like to accept our written or verbal quotation and you pay us a deposit (or if within 9 weeks of departure, you make full payment); or b) We issue you with a booking confirmation that will confirm the details of your booking and will be sent to you via email.
Your contract will be governed by Italian Law and is subject to the exclusive jurisdiction of the Italian courts at all times.
Lux Stays Puglia is not the owner of the accommodation booked and is required to provide personal details of the Party Leader and party members to which you consent.
At the time of booking, you will be required to pay a deposit of up to 30% of the total rental price, dependent on the particular property. The booking deposit of up to 30% of the total holiday price must be paid to Lux Stays Puglia before the holiday booking can be confirmed. The deposit is payable via Credit or Debit card, Bank Transfer, Cheque or Paypal at the time of booking.
The balance of the holiday is paid via Credit or Debit card, Bank Transfer or Paypal and must be received at least 30 days before the holiday start date.
If the balance is not paid to Lux Stays Puglia at 30 days before the holiday start date, Lux Stays Puglia reserves the right to cancel the holiday contract. In these circumstances, the booking deposit will not be refunded.
To cover accidental damage to the property and/or furnishings an insurance guarantee is required for each property to protect against any to the property. You will be required to all a hold on your credit card or to leave cash on the day of your arrival to the sum of €300 to €500 depending on the property. In the case of putting a hold of this sum on your credit card, this sum will be released 3 days after your checkout so long as no damages have occurred.
The Resort Representative and/or the owner or his representative reserves the right to deny access to the property if the customer does not pay this. In which case the customer will not be able to make any request for compensation for the rental price paid.
Please check your confirmation invoice, final itinerary and all other documents you receive from us, immediately on receipt. You must contact us immediately if any information appears to be incorrect as it may not be possible to make changes later and it may harm your rights if we are not notified of any inaccuracies in any document in a reasonable period of time (taking into account the date of your departure) and in any event no later than 7 days. If you cancel or alter your bookings later on, you may have to pay an amendment charge. We reserve the right to refuse your booking. If we do this, we will refund any money already paid to us.
If, after the confirmation invoice has been issued, you wish to change your travel arrangements in any way, for example, your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the Party Leader. Where we can meet a request, changes may be subject to payment of an administration fee based on our increased costs as a result of applicable rate changes and any costs or charges incurred or imposed by any of our suppliers. You will be notified of the amount of the fee before you choose to proceed with any change. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Where we are unable to assist you and you do not wish to proceed with the original booking, we will treat this as a cancellation by you.
If one of your party withdraws from the holiday, someone else can take their place providing they satisfy the conditions of the original booking, and you inform us in writing at least 14 days before departure. The Party Leader must sign the letter.
To cancel the entire holiday, the Party Leader must write to us directly, by recorded delivery at the address on your booking confirmation or via email to booking@luxstayspuglia.com. Cancellation takes effect on the day we receive your letter. If you cancel after you confirm your booking, you must compensate us for losses as we incur costs from the moment you make the booking. The closer your cancellation is to the departure date, the less likely we are to recover the costs by re-selling the holiday at the original price. Our cancellation charge therefore increases as the departure date approaches, as shown below.
If you have to cancel for a reason covered by your insurance policy, any losses must be claimed directly from the relevant insurance company. Claims must be made directly to the insurance company concerned.
The following cancellation charges apply:
More than 9 weeks prior to departure – deposit
63-0 days prior to departure – 100% of the cost of your holiday
In the event of minor alterations we will do our best to notify you before you travel. If a significant change or cancellation has to be made to your booking, we will notify you as soon as possible. You may then and subject to these Booking Conditions: a) accept the changed arrangements; b) accept an offer of alternative accommodation of comparable standard from us; c) cancel your booking completely, in which case we will refund you all monies paid by you.
During your holiday, and especially on check-out, we ask you to double-check the villa, to ensure you have not left any personal items at the villa. Common items left, are phone charges, clothes and keys.
Lux Stays Puglia, are not responsible for the return of these items, and returning items will incur an administration fee of €100, this will be charged on top of the cost of the postage, should Lux Stays Puglia agree to return the items.
Any personal items left in the property will be held by Lux Stays Puglia, for a period of two weeks.
If they are not claimed, they will be disposed of. Should you choose to arrange for the items to be picked up, Lux Stays Puglia are not responsible for the collection, delivery, or costs incurred.

Compensation will not be payable if we are forced to cancel or change your travel arrangements because of circumstances beyond our control (“Force Majeure”). These include, but are not limited to, war, threat of war, civil strife, riot, any labour dispute but not limited to strikes and industrial action, terrorist activity and its consequences or the threat of such activity, acts of God, natural or nuclear disaster, fire or explosion, chemical or biological disaster and adverse weather, sea, ice and river conditions, epidemics and pandemics, collapse of building structures or any similar events outside our or the supplier(s) control.
In the event that a Force Majeure event results in you having to stay at the accommodation longer than you have booked for, we will endeavour to arrange for you to stay at the accommodation at the pro rata rate at which you booked. For the avoidance of doubt, since a Force Majeure event is beyond our control, we will not have an obligation to pay you compensation.
We shall not be in breach of these booking conditions, nor liable for any failure or delay in the performance of our obligations under these booking conditions arising from a Force Majeure.
In the event of a Force Majeure which affects your travel arrangements, we would always advise you to contact your travel insurance provider to determine what cover is available under your policy.
All photographs and descriptions on this website belong to Lux Stays Puglia and may not be copied without prior written authorization.
For any dispute concerning bookings and lettings, only the Court of Bari will have jurisdiction and the Italian Law will apply.
By booking both Lux Stays Puglia and the client accept the terms and conditions detailed in this document.
Should some of the conditions of this contract be modified by the implementation of new laws, the validity of the remaining conditions cannot be questioned.
This is reserved exclusively for the people named on the confirmation invoice and no other persons are permitted to stay at the accommodation unless this has been agreed with us in writing and appropriate payments made (if applicable).
Should you or any other member of your party be responsible for any breakages, loss or damage of any item of the property or additional cleaning has been necessary, a charge will be made locally or an invoice will be sent to you.
Lux Stays Puglia and / or the property owner reserves the right to deduct any charges from the security deposit, where applicable.
Holiday insurance is the sole responsibility of each individual party member. Lux Stays Puglia accepts no liability for loss, damage, personal injury or the cost of medical or other treatment.
Lux Stays Puglia is an accommodation supplier on behalf of the Property Owner. It is not a Tour Operator and the Package Travel Directive (for short) does not apply to your booking which is for accommodation only. Any liability for loss or damage arising from your stay is the responsibility of the property owner and any claim must be brought against him. Our obligation to you is to take reasonable skill and care in selecting the accommodation offered to you. Lux Stays Puglia is not liable for loss, damage, injury or death caused by an event or circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes, or restraints or delays affecting carriers. Lux Stays Puglia will not accept liability if illness, injury or death is the fault of the Party Leader or any party member or other person not connected with your contract.
Lux Stays Puglia liability shall not in any event exceed the total holiday price.
Property descriptions are prepared many months in advance. We use reasonable care to ensure the information we provide is as reasonably accurate as possible but we rely on the Property Owner to provide us with full and up to date information about the Property.
All information contained within our website has been compiled from information which we amend as frequently as possible with any changes. However, there may be occasions when the advertised property is not as advertised, due to modification. Such situations may be due to local circumstances, water shortages, unsuitable weather conditions, fuel shortages, power cuts and other circumstances beyond our control. If we are advised of this we will notify you as soon as possible, but we cannot be held liable for circumstances beyond our control. It is also important to remember that depending on the season, some restaurants, communal pools, watersports and water parks do not operate at all times.
We try our very best to ensure that prices on our website are also accurate, however, occasionally, changes and errors occur and we reserve the right to correct prices in such circumstances. You must check the current price and all other details before your booking is confirmed. We reserve the right to amend the price of any unsold holiday rental at any time and correct errors in the prices of confirmed holidays.
The local stay tax which is payable on arrival, is usually a payment of €1 or €2 per night per person for a maximum number of nights, depending on the municipality where the property is located.
From time to time, building work and the associated noise is unavoidable. We do not control such work and we do not receive advance notification of when such work will commence. We will notify you as soon as we are made aware of any building work that will affect your holiday. However, we will not offer compensation.
Some facilities, activities, and excursions could involve an element of risk. These activities, facilities, and excursions are neither, run nor controlled by Lux Stays Puglia.
If the client wishes to participate, purchase or make use of any optional activities, facilities, or excursions Lux Stays Puglia regrets that Lux Stays Puglia cannot accept liability in relation to these. The contract for the provision of that activity, facility, or excursion will be between the client and that provider.
Usually, these locally paid for activities, facilities, and excursions will be subject to local law and jurisdiction.
The discretion to partake in any such activities, facilities, or excursions is entirely at the client’s own risk. The client(s) are responsible for taking sensible precautions for the safety of all children or family members for whom the client is responsible.
Please liaise with the supplier of the facility, activity, or excursion for the Terms and Conditions of the activity, facility or excursion, which will govern your contract.
If you have cause for complaint whilst on holiday, this must be brought to the attention of the local villa or apartment management team immediately so that action can be taken to rectify the problem. Unless there is a valid reason why you failed to report your complaint to the local management team, Lux Stays Puglia will not consider themselves to be liable for those complaints, which in any event will be the responsibility of the Property Owner.
Should the owner or local management company be unable to resolve the matter, details of the complaint must be notified to Lux Stays Puglia in writing within 28 days of the end of your holiday. Notification of any complaints received outside this period cannot be considered. If you do not tell us about your complaint properly, it may be difficult to investigate your complaint thoroughly.
Lux Stays Puglia can end your holiday if your behaviour, or that of any party member, is likely in our opinion to cause distress, damage, danger or to annoy our other customers, employees, accommodation or anyone else. In these circumstances Lux Stays Puglia reserve the right to refuse to complete your holiday arrangements and will not be liable for any refund, compensation or any other costs you have to pay. You agree you will exercise reasonable behaviour and will indemnify as appropriate the property owner if you cause any loss or damage whatsoever. Lux Stays Puglia cannot accept responsibility for the behaviour of others in your accommodation. Adults must supervise children at all times.
In Italy, especially villas in the countryside do not have a daily, or weekly rubbish collection.
All the rubbish (waste, debris etc.) must be disposed of according to the rules of the municipality where the property is located, and then put into the appropriate bins on the street or put into the special collection centres, where, if required are separated into (plastic, paper, glass, biodegradable, generic, etc.).
The villa must be left clean and the kitchen must be left without dishes and pots in the sink. The fridge should be emptied and cleaned.
A charge of € 100 may be applied to the clients that do not respect the above conditions and this amount will be deducted from the refundable security deposit.
Children must not use the swimming pool without adult supervision.
Unless otherwise advised, pets and animals are not permitted in the accommodation.
The property owner and their representative must be permitted to enter the property at all reasonable times upon giving 24 hours’ notice to inspect the property or contents, carry out necessary repairs to the property or to take meter readings.
While you are on holiday, we ask that you respect the condition of the accommodation and ensure that standards are maintained. You are on holiday and are not expected to clean the accommodation but you are required to remove any stains and replace items damaged by party members.
You must tell us before the booking if any person in your party as restricted mobility so that we can advise whether the property is suitable and if you do not do so we cannot be responsible for any loss.
In order to validate the booking, Lux Stays Puglia will hold personal information on the client.
Lux Stays Puglia is responsible for managing this data in line with the regulations UE 679/201 (UE Law) and will save this personal information on an independent database.
This data will be used by Lux Stays Puglia only to validate the booking and to communicate with the client during and after the stay. In any case, this personal information will not be shared with any other third parties (the only exceptions are in case of contract and Italian law obligations).
Lux Stays Puglia reminds the client that the client has the right to be informed and to oppose the use of this personal information as detailed in art. 17 of the above-mentioned art. 13 del UE 679/201.
If any clauses or provisions in these Conditions are not enforceable it will not affect the enforceability of the remaining Conditions.

In these circumstances Lux Stays Puglia reserve the right to refuse to complete your holiday arrangements and will not be liable for any refund, compensation or any other costs you have to pay. You agree you will exercise reasonable behaviour and will indemnify as appropriate the property owner if you cause any loss or damage whatsoever. Lux Stays Puglia cannot accept responsibility for the behaviour of others in your accommodation. Adults must supervise children at all times.
In Italy, especially villas in the countryside do not have a daily, or weekly rubbish collection.
All the rubbish (waste, debris etc.) must be disposed of according to the rules of the municipality where the property is located, and then put into the appropriate bins on the street or put into the special collection centres, where, if required are separated into (plastic, paper, glass, biodegradable, generic, etc.).
The villa must be left clean and the kitchen must be left without dishes and pots in the sink. The fridge should be emptied and cleaned.
A charge of € 100 may be applied to the clients that do not respect the above conditions and this amount will be deducted from the refundable security deposit.
Children must not use the swimming pool without adult supervision.
Unless otherwise advised, pets and animals are not permitted in the accommodation.
The property owner and their representative must be permitted to enter the property at all reasonable times upon giving 24 hours’ notice to inspect the property or contents, carry out necessary repairs to the property or to take meter readings.
While you are on holiday, we ask that you respect the condition of the accommodation and ensure that standards are maintained. You are on holiday and are not expected to clean the accommodation but you are required to remove any stains and replace items damaged by party members.
You must tell us before the booking if any person in your party as restricted mobility so that we can advise whether the property is suitable and if you do not do so we cannot be responsible for any loss.
In order to validate the booking, Lux Stays Puglia will hold personal information on the client.
Lux Stays Puglia is responsible for managing this data in line with the regulations UE 679/201 (UE Law) and will save this personal information on an independent database.
This data will be used by Lux Stays Puglia only to validate the booking and to communicate with the client during and after the stay. In any case, this personal information will not be shared with any other third parties (the only exceptions are in case of contract and Italian law obligations).
Lux Stays Puglia reminds the client that the client has the right to be informed and to oppose the use of this personal information as detailed in art. 17 of the above-mentioned art. 13 del UE 679/201.
If any clauses or provisions in these Conditions are not enforceable it will not affect the enforceability of the remaining Conditions.
